Terms of Service
Plain-English summary: HeroWitness is a documentation and deterrence tool — not a law firm, not a licensed security company, and not a substitute for calling 911. Your incident files belong to you. Use the service lawfully. Don't use it to harass or surveil people.
1. What HeroWitness Is
HeroWitness provides an AI-powered digital witness service that assists subscribers in documenting confrontations and incidents via video recording, AI-generated incident reports, and optional connections to licensed attorneys. HeroWitness is a technology platform, not a licensed security company, private investigator, or law firm.
2. Your Responsibilities
Legal use
You agree to use HeroWitness only for lawful purposes. You are responsible for understanding and complying with recording consent laws in your jurisdiction. HeroWitness provides automatic consent-law routing (see our Recording Laws page), but this does not constitute legal advice and does not guarantee compliance in every circumstance.
Prohibited uses
- Using HeroWitness to stalk, harass, or surveil individuals without a legitimate safety purpose
- Activating sessions to record people without a genuine confrontation or safety concern
- Using incident footage for any purpose other than your own legal protection and documentation
- Sharing footage in a way that violates any person's privacy rights or applicable law
- Misrepresenting HeroWitness as a licensed law enforcement or security service
3. What HeroWitness Is Not
- Not a 911 replacement. If you are in immediate physical danger, call 911. HeroWitness cannot dispatch emergency services on your behalf except at your explicit request via the in-session 911 relay feature.
- Not a law firm. Attorney connections through HeroWitness are referrals to independent licensed attorneys. HeroWitness does not provide legal advice.
- Not a licensed security company. HeroWitness AI agents are software tools, not licensed security guards.
4. Subscriptions and Billing
HeroWitness subscriptions are billed monthly or as pay-per-use. Founding member pricing is locked for the duration of the account. Subscriptions auto-renew unless cancelled. You may cancel at any time through your account settings — cancellation takes effect at the end of the current billing period.
Refunds are not available for partial months. If a technical failure on our part prevents you from using a paid feature, contact us at hello@herowitness.com and we will make it right.
5. Your Data and Evidence Files
Your incident recordings, transcripts, and reports belong to you. We do not sell, share, or use your incident data for any purpose other than providing the service. See our Privacy Policy for full details.
Deleting an incident from your vault is permanent and irreversible. We recommend downloading evidence packages before deletion in any incident that may have future legal relevance.
6. Attorney Network
Attorneys accessible through HeroWitness are independent licensed practitioners. HeroWitness facilitates introductions through a marketplace model — attorneys pay a platform listing fee to participate. HeroWitness does not receive referral fees from attorneys in connection with any specific case. The attorney-client relationship, if any, is solely between you and the attorney you engage.
7. Limitation of Liability
HeroWitness is provided "as is." We make no guarantee that the service will prevent any confrontation, secure any legal outcome, or satisfy any recording-consent requirement in any specific jurisdiction. To the fullest extent permitted by law, HeroWitness's liability for any claim arising from use of the service is limited to the subscription fees you paid in the three months preceding the claim.
8. Changes to These Terms
We will notify subscribers of material changes to these Terms via SMS at least 14 days before they take effect. Continued use of HeroWitness after that date constitutes acceptance of the updated Terms.
